AB - The importance that small water bodies, most often called ponds, have in preserving unique biodiversity and providing unique ecosystem services is well known in the scientific world. Many ponds are present on the territory of Romania, which, due to weak rural development in the last century, remained preserved. Today, many of these ponds are protected at the national level, as part of larger territories as protected areas, and at the international level, applying the laws of the European Union. However, a more efficient implementation of by-laws is needed to ensure the
complete protection of these fragile aquatic habitats and replace the incomplete legal protection of EU directives related to habitats. Awareness raising and education about the importance of ponds is needed among the immediate users of the areas where these small waters are located.
Furthermore, it is necessary to regulate and stimulate the collaboration of relevant stakeholders. Recommendations for improving the legal and practical protection of ponds at the landscape level are given.

AB - Ponds, the most numerous freshwater habitats globally, are becoming increasingly recognized as being important for rare, endemic and endangered species, owing to the high levels of biodiversity they support and their role in ecosystem services. However, they remain largely overlooked and widely excluded from policies that might protect them. Even though their size and permanence are highly important for their legal protection, these two characteristics are not precisely and universally defined in theory and in international legal documents. International legislative frameworks do not seem to provide global, comprehensive, or detailed protection of ponds as significant and widespread habitats. On the contrary, they safeguard only fragmentary small water bodies – either by protecting certain types or only those that are parts of larger protected areas. Also, pondscapes are not specifically recognized as forms in need of legal protection. In this paper, the complexity of the legal protection of ponds is presented, followed by recommendations. These should be transformed into legal norms, and given their number and complexity be presented within a single, unique convention that would specifically address the protection of ponds globally. This type of protection would be the most effective legal tool.

AB - Small standing waterbodies are very important guardians of exceptional biodiversity. There are numerous freshwater habitats in Montenegro, present in all state regions, with a unique role in ecosystem services. However, the national legislative framework does not provide a comprehensive protection of these significant water habitats. Moreover, these habitats are not adequately protected at the international level. Its fragmentary protection is provided at the regional or local level in some countries. mostly indirectly. Pondscapes, as the most appropriate scale to protect small standing waterbodies, is not recognized or defined in (inter)national law. Apart from political and economic, the interests in the nature protection of Montenegro are focused on the European Union, as well. Thus, the establishment of habitat protection adapts to this system. The complexity of legal protection of small standing waterbodies in Montenegro was analyzed. Furthermore, some useful recommendations through which the protection of these valuable aquatic habitats could be improved, are given. These recommendations should be transformed into legal norms and adopted as amendments or as separate regulations. To protect small water habitats in a more efficient way, it is necessary to implementexpand some norms of the European Union legislation related to habitat protection, previously adjusted and harmonized with the state of national nature protection. Because aquatic habitats are ecologically significant, and can be used for ecotourism development, a more rigorous approach is needed in the process of assessing the acceptability of plans and the implementation of activities within these areas. Therefore, harmonization of strategies and action plans of all management sectors of Montenegro is necessary, to ensure the protection of entire ecological networks. More ways to effectively protect small standing waterbodies in legally (non)binding forms are provided.
